These Terms of Service are an agreement between you and 10X Ventures LLC (“10X Ventures,” “we” or “us”), a California limited liability company. They govern your use of Harbor Heist (the “game”), its related services and this website. By downloading or playing Harbor Heist, you agree to these terms and to our Privacy Policy.
Who can play
You must be at least 13 years old to play Harbor Heist. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you, and they are responsible for your use of the game, including any purchases.
Virtual items and purchases
Harbor Heist is free to download and play, and every in-app purchase is optional. It is made for entertainment: it offers no real-money gambling and no chance to win money or prizes of real-world value. Bait, coins and every other item in the game are virtual items with no cash value, and they cannot be exchanged for money.
Harbor Heist uses virtual items such as bait, coins, life rings, cards, pets and offers. We license virtual items to you for use inside the game only. They have no cash value, cannot be exchanged for money, goods or anything of real-world value, and cannot be sold or transferred outside the game’s own features.
Casts, raids, heists and some rewards have random outcomes. They pay out only virtual items, and the game never offers a cash prize or a prize of real-world value. The chance of each catch is on our cast odds page.
Purchases are processed by Apple or Google Play under their own terms, and refunds follow the policy of the store where you bought (on the App Store, request one at reportaproblem.apple.com; on Google Play, from your order history). Bait, coins and offers are consumable: once they reach your game account, they are used up as you play. We may change, rebalance or retire virtual items and game features as the game grows.
Your account and fair play
You can play as a guest, or on iPhone and iPad sign in with Apple to keep your harbor across devices. You are responsible for the accounts you connect and for what happens in your game. When you play, you agree to:
- choose a captain name free of hate, harassment, sexual content and other people’s personal information;
- treat other players with respect, and use the game’s report and block tools when someone does not;
- play the game as we publish it, with no cheats, bots, modified apps, exploits of bugs or tools that change balances or outcomes;
- keep one account for yourself, with no buying, selling or sharing of accounts or virtual items.
Suspension and termination
We may suspend or close an account, remove its virtual items or rename a captain when we reasonably believe the account broke these terms, put other players at risk or broke the law. Where we can, we will tell you in the game or by email, and you can respond by writing to support@harborheist.com. Virtual items have no cash value, so they are not refunded when an account is closed for breaking these terms, except where the law requires it.
You can stop playing at any time and delete your account in the game’s Settings, as described on the account deletion page. Deleting your account permanently removes your harbor and your virtual items.
License to use the game
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and play Harbor Heist on Apple or Android devices that you own or control, as the usage rules of the App Store or Google Play allow. These terms also cover updates we release. You may not copy, modify, reverse engineer or distribute the game, except where the law allows it despite this limit. We and our licensors keep all rights in the game, its art, music, characters and code.
Technical data
You agree that we may collect and use technical information about your device, system and the game to deliver updates, support and the game’s services. Our Privacy Policy describes this in full.
Apple and the App Store
These terms are between you and 10X Ventures. Apple is not a party to them and is not responsible for the game or its content. Apple has no obligation to provide maintenance or support for the game. If the game fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the game. Apple is not responsible for claims relating to the game, including product liability claims, claims that the game fails to meet a legal or regulatory requirement, consumer protection claims, or claims that the game infringes someone’s intellectual property; we are responsible for investigating and handling those claims as these terms provide. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on a U.S. Government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Services from others
The game may connect to services run by others, such as Apple sign-in, the App Store and Google Play. Your use of those services is also governed by their own terms.
Disclaimer of warranties
TO THE FULLEST EXTENT THE LAW ALLOWS, HARBOR HEIST IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT PROMISE THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR AVAILABLE AT ANY PARTICULAR TIME.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, 10X VENTURES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST VIRTUAL ITEMS, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50 IF THAT IS GREATER.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim there. Nothing in these terms limits consumer rights that cannot be waived where you live.
Changes to these terms
We may update these terms as the game grows. We post the new version on this page with a new effective date, and continuing to play after a change means you accept it.
